ENVIRONMENTAL
We offer advice on environmental issues. Judicial and administrative proceedings, audits, licensing and environmental management.
ARBITRATION AND MEDIATION
Consultancy, ad hoc strategic arbitration proceedings in the main Brazilian arbitration institutions, especially commercial and civil disputes. Drafting and review of an arbitration agreement, preparatory measures for arbitration, enforcement of an award or actions for annulment of an arbitration award. Civil and business mediations, with creative solutions for out-of-court settlements.
CIVIL
Consultancy, strategic and routine litigation, especially commercial and civil litigation, negotiation, contracts, debt securities, civil liability, rights in rem, real estate law, personality rights for the protection of legal entities.
COMPETITIVE
Administrative proceedings before the CADE (Administrative Council for Economic Defense), both in the defense of clients in investigations of cartel practices, and in the promotion of representations against abusive market practices. Advisory role in the design, review and implementation of antitrust compliance programs, including training modules for senior management. Advisory role also in the analysis of competition risks in mergers and acquisition projects and commercial practices in general. In the judicial sphere, we act in the filing of actions against CADE's condemnatory decisions, as well as in indemnity actions based on antitrust competition law.
CONSUMER
Consultancy and clarifications to the consumer Protection Service (PROCON), the Department of Consumer Protection and Defense (DPDC), the Public Ministry (Public Prosecuters), the press and other public administration bodies. In the judicial sphere, we prepare defenses and appeals in Civil Consumer Courts, especially in public civil actions and preparation of terms of conduct adjustment.
Criminal
Criminal prevention, through internal investigation and fraud analysis, compliance, consulting and training. In addition to presentations and workshops that seek to clarify criminal liability to employees in order to reduce risk of litigation. In litigation, we work with crimes against the environment, crimes against the tax system, and crimes against consumers, among others.
SOCIAL SECURITY
Advising clients on the interpretation of legislation relating to social security contributions. In litigation practice, we act in the support of judicial and administrative defenses against social security tax assessment. In judicial measures we act in the scope of tax foreclosures and in actions aimed at obtaining judicial recognition of the non-levy of contributions on installments that, due to their legal nature, should not form part of the contribution calculation basis.
PRIVACY AND DATA PROTECTION
Advice and compliance on General Personal Data Protection Law (LGPD), consultancy on contracts, digital law, privacy and data protection.
INTELLECTUAL PROPERTY
Consultancy, searches, filing and processing of Industrial and Intellectual Property rights, with regard to registration and its protection. In the judicial sphere, we act in actions related to the protection of Industrial and Intellectual Property rights, as well as in actions that include a claim of nullity or infringement of any immaterial right.
LABOR
Consultancy, assistance in strikes and, in the judicial sphere, in routine and strategic processes, including public civil actions and actions filed by Unions. In the administrative sphere we act in the Public Ministry of Labor and in the execution of terms of conduct adjustment, as well as in the Special Secretariat for Welfare and Labor of the Ministry of Economy.
TAXATION
Consultancy and tax planning, with the preparation of memoranda on the interpretation of tax legislation. In litigation, we act before the Trial Courts, supporting administrative defenses and filing lawsuits. We follow the inspection procedures with the federal, state and municipal tax collection bodies, as well as assist in the regularization of the company's tax situation, in obtaining debt clearance certificates and in the granting of tax incentives.
INSOLVENCY AND RESTRUCTURING
Defense of creditors and investors, such as qualifying claims in judicial or extrajudicial reorganizations and bankruptcies. Various judicial measures to preserve claims and enforce guarantees, classification of claims, challenges, objection to the judicial reorganization plan, participation in General Meetings of Creditors. In addition we aim to provide an amicable restructuring implemented out of court.
